1. Scope and Who We Are
This Privacy Policy explains how Chubble Gum LLC ("Chubble Gum," "we," "us," or "our") collects, uses, discloses, retains, and protects personal information when you visit https://chubblegum.com, purchase or subscribe to our products, create an account, contact us, participate in promotions, interact with our social-media pages, or use any service that links to this Policy (collectively, the "Services").
Chubble Gum LLC is the business responsible for the personal information covered by this Policy. This Policy does not apply to a third party's independent practices, even when its website or service is linked from our Services. Our Terms of Service govern use of the Services and are available at https://chubblegum.com/policies/terms-of-service.
2. Personal Information We Collect
The information we collect depends on how you interact with us. We may collect the following categories of personal information:
- Identifiers and contact details, such as name, email address, telephone number, billing and shipping addresses, account username, and online identifiers.
- Transaction and commercial information, such as products viewed or purchased, order and subscription history, returns, discounts, gift-card activity, preferences, and customer-service records.
- Payment-related information. Payment card details are collected and processed by our payment providers. We generally receive limited details such as payment status, transaction identifiers, billing address, and card type or last four digits.
- Device, internet, and network activity, such as IP address, browser and device type, operating system, referring URLs, pages viewed, clicks, search activity, session data, cookie identifiers, approximate location derived from IP address, and interactions with emails, ads, or messages.
- Communications and content, such as emails, chat or support messages, reviews, survey responses, contest entries, order notes, photos, videos, social-media tags, and other content you choose to provide.
- Marketing and mobile-messaging information, such as email or mobile number, consent records, opt-in source and timestamp, messaging preferences, message content, delivery status, and engagement data.
- Fraud-prevention and security information, such as risk signals, chargeback information, login activity, and records used to protect accounts, transactions, customers, and the Services.
- Inferences, such as likely product interests or preferences derived from purchases and interactions with the Services.
Some information may be considered sensitive under certain laws, including account credentials, precise payment information handled by payment providers, or the contents of private communications. We use sensitive information only as reasonably necessary to provide requested services, process transactions, maintain security, comply with law, or for another purpose permitted by applicable law. We do not use sensitive information to infer characteristics about you except as permitted by law.
3. How We Collect Personal Information
We collect personal information from the following sources:
- Directly from you, including when you order, subscribe, join a list, create an account, communicate with us, enter a promotion, submit a review, or provide content.
- Automatically from your browser or device through cookies, pixels, tags, SDKs, server logs, local storage, and similar technologies.
- From service providers and business partners, including Shopify, Klaviyo, payment processors, shipping carriers, fraud-prevention vendors, analytics providers, social networks, review providers, and customer-support tools.
- From public sources or other people, such as public social-media posts that tag Chubble Gum, referrals, gift purchasers, or information you make public.
4. How We Use Personal Information
We may use personal information to:
- provide, operate, personalize, maintain, and improve the Services;
- process payments, orders, shipments, returns, exchanges, subscriptions, and customer-service requests;
- create and manage accounts, preferences, loyalty or promotional participation, and transaction records;
- send transactional communications, such as order confirmations, delivery updates, subscription notices, account alerts, and support responses;
- send marketing communications where permitted, including email, SMS, MMS, and RCS messages, and honor opt-out requests;
- measure site, campaign, and message performance; understand customer interests; and personalize our own website and communications;
- detect, investigate, and prevent fraud, abuse, security incidents, prohibited activity, and violations of our terms;
- protect our rights, customers, personnel, property, and Services; enforce agreements; and establish, exercise, or defend legal claims;
- comply with legal, tax, accounting, reporting, regulatory, and law-enforcement obligations; and
- carry out another purpose disclosed when information is collected or with your direction or consent.
5. Cookies, Analytics, and Cart Activity
We and our service providers use cookies and similar technologies to keep the Services working, remember preferences and cart contents, secure transactions, understand usage, and measure the performance of our website and communications. Service providers may process this information only to perform services for Chubble Gum or as otherwise permitted by law; they may not use it for their own advertising purposes.
The website uses cookies, pixels, plugins, and similar technologies to keep track of items placed in a shopping cart, including when a cart or browsing session appears to have been abandoned. If you have consented to mobile or email marketing, this information may be used to determine when to send cart or browse reminder messages by email, SMS, MMS, or RCS.
We do not sell, rent, or share your personal information - including your mobile opt-in and SMS consent data - with third parties for advertising purposes. We do not permit third-party advertising networks, social-media platforms, or data brokers to use personal information collected through the Services for their own advertising, audience creation, or cross-context behavioral advertising.
You can adjust browser controls to block or delete cookies, but some Services may not function properly. Browser "Do Not Track" signals are not uniform, and we do not respond to them unless required by law. Cookie choices may be browser- and device-specific and may need to be renewed if cookies are cleared.
6. Email Marketing
If you subscribe to marketing emails, we may send product announcements, promotions, recommendations, restock notices, surveys, and related content. You can unsubscribe using the link in a marketing email or by contacting us. We may still send non-promotional messages about orders, subscriptions, accounts, legal notices, security, or customer service.
7. Mobile Messaging Privacy (SMS, MMS, and RCS)
If you opt in to the Chubble Gum mobile messaging program, we may collect and use your mobile telephone number, messaging preferences, consent records, opt-in source and timestamp, message content, device and carrier information, delivery status, and engagement data to provide, administer, support, secure, personalize, and improve our SMS, MMS, and RCS messaging program. Messages may include promotions, product launches, abandoned-cart or browse reminders, recommendations, order and shipping updates, subscription notices, account information, and customer-care communications, as described in our Terms of Service.
We will not share your opt-in to a Chubble Gum SMS, MMS, or RCS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We do not sell, rent, or share mobile opt-in data, text-message originator opt-in data, or consent status with third parties or affiliates for advertising, marketing, or promotional purposes. Mobile opt-in data and consent are protected by the same unconditional no-sale, no-rental, and no-advertising-sharing commitment that applies to all personal information under this Policy.
We may disclose mobile information, including your telephone number and opt-in or consent status, to service providers that help us provide the messaging service, such as Klaviyo, messaging-platform providers, telecommunications carriers, phone companies, hosting providers, customer-support vendors, and vendors that route, deliver, secure, analyze, or support messages. They may use the information only to perform services for us or as otherwise permitted by law.
You can opt out by replying STOP to a message or using an available unsubscribe link. For help, reply HELP or email support@chubblegum.com. We retain consent and opt-out records as reasonably necessary to honor your choices, document compliance, prevent unwanted messages, and resolve disputes. See the Mobile Messaging Program Terms in our Terms of Service for additional details.
8. How We Disclose Personal Information
We may disclose personal information to the following recipients for the purposes described in this Policy:
- Service providers and contractors that support ecommerce hosting, payments, fraud prevention, order fulfillment, shipping, subscriptions, cloud hosting, IT, security, analytics, customer support, reviews, email, mobile messaging, and professional services.
- Analytics and website-measurement service providers that process information only on our behalf to help us understand and improve the Services. They are not authorized to use this information for their own advertising purposes.
- Government authorities, courts, regulators, law enforcement, and other parties when we reasonably believe disclosure is required or appropriate to comply with law, respond to lawful process, protect rights or safety, investigate fraud or security issues, enforce agreements, or establish or defend claims.
- A buyer, investor, lender, adviser, or other participant in an actual or proposed merger, financing, reorganization, sale, bankruptcy, or transfer of some or all of our business or assets, subject to appropriate confidentiality and legal requirements.
- Other recipients at your direction, with your consent, or as disclosed when information is collected.
We may use and disclose information that has been aggregated or deidentified so it cannot reasonably be linked to you. We will maintain deidentified information in deidentified form and will not attempt to reidentify it except as permitted by law.
9. No Sale, Rental, or Advertising Sharing
We do not sell, rent, or share your personal information - including your mobile opt-in and SMS consent data - with third parties for advertising purposes.
We do not disclose personal information to advertising networks, social-media platforms, data brokers, or other third parties for their own advertising, audience creation, direct marketing, or cross-context behavioral advertising. We may use service providers for internal analytics and measurement, but only under instructions and restrictions that prohibit them from using personal information for their own advertising purposes. We do not knowingly sell or share personal information of consumers under 16.
10. Payment Processing
Payments are processed by third-party payment providers under their own privacy notices and security practices. We do not store complete payment-card numbers or card security codes on our systems. We may receive transaction identifiers and limited payment information needed to complete orders, prevent fraud, process refunds, keep records, and resolve disputes.
11. Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide Services; fulfill orders and subscriptions; maintain transaction, tax, consent, suppression, warranty, and customer-service records; prevent fraud; comply with legal obligations; and establish, exercise, or defend claims. Retention periods vary based on the type of information, our relationship with you, legal requirements, operational needs, and the sensitivity and risk of the information.
When information is no longer needed, we may delete, anonymize, or securely isolate it. Backup copies may remain for a limited period until overwritten. An opt-out or deletion request may not require us to delete information that must be retained to honor the request, complete a transaction, maintain security, comply with law, or exercise legal rights.
12. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including access controls, encryption in transit where appropriate, vendor management, and security monitoring. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of account credentials and notifying us of suspected unauthorized access.
13. Your Privacy Rights and Choices
Depending on where you live and subject to legal exceptions, you may have rights to request access to or confirmation of personal information; obtain a copy; correct inaccuracies; delete information; restrict or object to processing; withdraw consent; limit certain uses of sensitive information; exercise other applicable privacy choices; or appeal a denied request. You may also have the right not to receive discriminatory treatment for exercising privacy rights.
To submit a request, email support@chubblegum.com with the subject "Privacy Request" and describe the right you wish to exercise. To opt out of email, use the unsubscribe link. To opt out of mobile messages, reply STOP.
We may need to verify your identity by matching information you provide with our records or requesting additional information. We will use verification information only for that purpose. An authorized agent may submit a request where permitted, but we may require proof of authorization and direct verification with you. If we deny a request, you may appeal by replying to our decision with "Privacy Appeal" in the subject line. You may contact the appropriate regulator if you remain dissatisfied.
14. U.S. State Privacy Disclosures
Residents of states with comprehensive privacy laws may have the rights described above when those laws apply to Chubble Gum. During the preceding 12 months, we may have collected the categories described in Section 2, used them for the purposes in Section 4, and disclosed them to the service-provider and other recipient categories in Section 8. We do not sell, rent, or share personal information with third parties for advertising purposes, and we do not use or disclose sensitive personal information for purposes that trigger a right to limit under California law.
We do not disclose personal information to third parties for their own direct-marketing purposes. California residents may contact us with questions under California's "Shine the Light" law. Nevada residents may submit a verified request concerning covered sales under Nevada law by emailing us, although we do not sell covered information for monetary consideration.
Nothing in this section grants a right that does not apply under the law governing your request. We will respond within the time and in the manner required by applicable law.
15. International Visitors
Chubble Gum is based in the United States. If you access the Services from another country, personal information may be transferred to, stored in, and processed in the United States and other countries where our providers operate. Those countries may have different data-protection laws. Where required, we rely on recognized transfer mechanisms and safeguards.
For individuals in the European Economic Area, United Kingdom, or Switzerland, our legal bases may include performance of a contract (such as fulfilling an order), compliance with legal obligations, legitimate interests (such as improving and securing the Services, preventing fraud, and conducting appropriate marketing), and consent where required. You may withdraw consent at any time without affecting prior processing. You may object to or restrict certain processing and lodge a complaint with your local data-protection authority.
For Canadian residents, we process personal information with consent or as otherwise permitted by applicable law. You may request access or correction, withdraw consent subject to legal or contractual restrictions, or contact the applicable privacy regulator. Withdrawal may affect our ability to provide requested Services.
16. Children's Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. We do not knowingly sell or share personal information of consumers under 16. If you believe a child has provided personal information to us, contact support@chubblegum.com so we can investigate and take appropriate action.
17. Reviews, Order Notes, and Public Content
Information you post publicly, such as reviews, comments, photos, videos, or social-media tags, may be visible to others and may be copied or used outside our control. If you submit an order note, we may use limited, non-sensitive portions of the note, a first name or initials, and ordered-product information for order-packing or social content as described in our Terms of Service. We do not intentionally display full shipping addresses, full legal names, payment information, telephone numbers, or email addresses. To opt out prospectively, write "Please do not use my order for content" in the order notes or email support@chubblegum.com.
18. Third-Party Services and Links
The Services may link to or integrate with Shopify, payment providers, carriers, social networks, review platforms, and other third parties. Their privacy notices govern their independent collection and use of personal information. We encourage you to review those notices before providing information.
19. Changes to This Policy
We may update this Policy to reflect changes in our practices, technologies, legal obligations, or Services. We will post the revised Policy at this URL and update the effective date. If changes are material, we will provide additional notice or obtain consent when required. Your continued use of the Services after the effective date is subject to the revised Policy, except where law requires a different process.
